1. Professional Capacity Disclaimer

I am a licensed Nurse Practitioner; however, all information, guidance, and support provided through this platform are offered solely in my capacity as a certified health coach. Nothing on this platform — including self-guided programs, coach-guided programs, written content, videos, recommendations, or product suggestions — constitutes medical advice, diagnosis, treatment, or the practice of medicine.

Although my background includes medical training, I am not acting as your medical provider in this context. All recommendations are grounded in health coaching principles and general wellness education. They are not a substitute for professional medical care.

Self-Guided Programs

Coach-Guided Programs

While coach-guided programs include direct interaction, this interaction remains strictly within a health coaching capacity. Communications with your coach are not a patient-provider relationship and are not protected by HIPAA as a clinical encounter.

For both program types, you agree that:

You will consult a licensed physician or healthcare provider before beginning any program
You will disclose any pre-existing medical conditions, injuries, or medications to your coach
You take full personal responsibility for your health decisions
Results are not guaranteed and vary by individual

3. Nutrition Products — Disclaimer & Compliance

Products sold on this platform, including supplements, protein powders, meal replacements, or any food-related products, are intended to support a general wellness lifestyle and are not intended to diagnose, treat, cure, or prevent any disease.

You acknowledge:

These statements have not been evaluated by the Food and Drug Administration (FDA)
You will review all ingredient labels before use, particularly if you have allergies, sensitivities, or take prescription medications
You will consult your physician before adding any supplement to your regimen, especially if you are pregnant, nursing, or managing a chronic condition

4. Skin Care Products — Disclaimer & Compliance

Skin care products sold through this platform are intended for general cosmetic use and general skin wellness support only. They are not intended to diagnose, treat, cure, or prevent any skin condition or disease.

8. Product Returns, Refunds & Program Cancellations

Physical Products: food cannot be returned. Skin care can be returned unopened within 14 days of purchase.
Digital/Self-Guided Programs: Due to the digital nature of this content, all sales are final unless otherwise stated
Coach-Guided Programs: Cancellation and refund terms are outlined at checkout and in your program agreement

9. Intellectual Property

All content on this platform — including programs, videos, written materials, recipes, guides, and branding — is the intellectual property of Daymark Wellness. Unauthorized reproduction, redistribution, or resale is strictly prohibited.

10. Limitation of Liability

To the fullest extent permitted by law, Daymark Wellness LLC. and its owner(s) shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of this platform, its programs, or its products. Your sole remedy for dissatisfaction is to discontinue use.

These Terms & Conditions are governed by the laws of the State of Arkansas without regard to conflict of law provisions. Any disputes shall be resolved in Benton Co., Arkansas.
